Measures to better enforce the People's Republic of China Anti-Domestic Violence Law were adopted by unanimous vote at the 22nd meeting of the Standing Committee of the 13th Guangdong Provincial People's Congress on July 29.
A staff member of the Guangdong Women's Federation, one of the organizations responsible for drafting the measures, said they constitute an innovative anti-domestic violence work system and measures with the province's characteristics.
The measures stipulate that acts of domestic violence can be divided into five categories:
injurious behavior, restriction of personal freedom, threatening of personal safety, psychological abuse and other forms of domestic violence.
A social governance system based on participation should be established to carry out anti-domestic violence work. There are several provisions clarifying the responsibilities and obligations of the people's organizations, villagers' committees, neighbors' committees, social organizations, enterprises and public institutions in anti-domestic violence work.
A comprehensive prevention system for anti-domestic violence work should be established that defines the responsibilities of all parties concerned in terms of publicity and education on family virtues, laws and regulations on anti-domestic violence as well as training, information resource construction and sharing and family conflict resolution.
People who are unable to report domestic-violence cases because of old age, disability, serious illness, coercion or intimidation are included in the list of those protected. Mediation organizations and their staff are designated as mandatory reporting parties for them.
Reception and handling of reports to police or public security organs are standardized. It is clearly stipulated that handling domestic violence cases should be included in the duties of the "110," the emergency police hotline.
When receiving a report, the police should respond in time, keep police records, stop the acts of domestic violence, find out the basic facts, assist in providing shelter and inform the victims of their rights.
A special chapter is also set up in the measures to clarify the steps of providing temporary shelter and social, legal and judicial assistance in a bid to provide multilevel and diversified assistance to victims.
The family and lawyer investigation and evidence collection systems are improved in the measures. Victims who are not able to collect evidence in domestic violence cases can entrust lawyers to help them do so.
Minors who witness violence in their families are also regarded as victims of domestic violence so as to enhance the protection of juveniles.
"It's a great step to enforce the anti-domestic violence law, and it's of significance to the anti-domestic violence work in the province, protection of the legal rights of women and children, promotion of family harmony and the stability of the whole society," said a staff member of the Guangdong Women's Federation.
The measures will be effective from October 1 this year.
